Hanazawa's Commission Terms of Service (TOS)
It is the buyer's responsibility to be familiar with these terms. By purchasing a commission from me, you are implicitly agreeing to these terms, and to be bound and/or subject to them.
** Communication
*All commission communication must be conducted either through private messaging (notes) or via email. I will provide my email address to anyone with legitimate interest in buying who prefers email over notes, just ask!
*Any communication via comments or instant messages are subject to being lost/deleted without record and cannot be considered valid for the purpose of recording any business transaction.
*I will do my best to reply to commissioners within a reasonable time frame (up to 3 days unless there is some extenuating circumstance) and I expect the same in return in order to expedite completion of the commissioned work.
** Pricing
*All pricing is subject to change at any time, including base pricing, sales specials, promotions, etc.
*Pricing listed on any commission price sheets should be considered base prices and can increase based on the complexity of characters, costuming, posing, props, or backgrounds. Providing details of the desired character/scene is necessary for accurate price quotes; I will request more information if necessary before giving a quote.
*It is solely my discretion to decide whether or not to offer special pricing to any commissioner at any time for any reason (loyalty/repeat/volume discounts, etc).
** Payment
*I NO LONGER ACCEPT PAYPAL AS A FORM OF PAYMENT.
Google Wallet, Square Cash, and Square Marketplace (for credit and debit payments) are reputable, secure, and proven methods of making payments and include fraud protection among other buyer protection services. I am happy to provide additonal information about these payment methods, and to communicate with commissioners to determine which method of payment is best for them/us. I have provided a basic primer here.
*Payment for commissions are to be made in full prior to the completion of any work by the artist, unless other arrangements are made. I have a strong enough record and reputation, including consistently short waiting lists and reasonable turnaround time, to substantiate this requirement.
*Payment for large commissions may be made in installments, to be determined/agreed upon at time of purchase. Work on commissions paid in installments will be relative to the amount paid. For example, if $50 is paid, no more than $50 worth of work will be completed until additional payments are made.
*Payment for auction winners, YCH/pre-pose commissions, or wing-its must be paid within 48 hours of winning unless other arrangements are made. If it will take longer for you to make your payment, you must notify me in advance. Additional provisions on these special commissions may be included in the specific posting or journal in which they are offered.
** Content
*I reserve the right to refuse any commission from any one at any time based on the requested content of the image. Although I am comfortable drawing many subjects, there are some themes, fetishes, and situations that I will not draw. While it is impossible for me to provide a comprehensive list of what I will not draw, I am more than willing to discuss your ideas in a polite, professional manner. However, No means NO if I say I am not interested in drawing your subject.
*Characters from copyrighted/trademarked properties are a gray area, both legally and morally. I may or may not draw any given character from any given series, game, movie, etc. based on personal discretion and the content of the request. Fan characters are generally okay, as long as I am not expected to draw in the style of the source material, unless I specifically agree to it in advance.
*If commissioning art of original characters that belong to other people (other furries, etc), I will generally accept these kinds of commissions as long as everything "looks right" - there is a publicly expressed connection between the buyer and the giftee, the subject/theme of the art is consistent with artwork that person appears to like, etc. Under certain circumstances, I may ask for additional information, up to and including consent from the giftee, to verify that they are okay with the request before I agree to draw their character.
** Revisions
*A reasonable number of revisions are included in my pricing structure. I try to be thorough in gathering the information I need before I begin drawing to reduce the number of potential major revisions.
*It is my sole discretion whether or not to make minor revisions, as well as to define what constitutes a minor revision. I will be reasonable if the buyer is reasonable. Spending hours making minor corrections is a waste of my time, disruptive to my process, and impacts my ability to complete other clients' commissions in a reasonable timeframe.
*Wing-it type commissions, by definition, do not provide any progress updates. Revisions are made only if there is a glaring error.
*Your Character Here and Pre-posed commissions/auctions may include fewer updates because the primary pose has already been decided. In cases where there are numerous characters from multiple buyers, updates may be fewer in order to provide a complete image in a more timely manner, so that one person does not hold up the whole image for everyone else.
** Buyer's Rights
*The vast majority of commissions will fall under the following rules:
-Commissioned art may be reposted to the commissioner's personal gallery, or any image board site, as long as the artwork is un-altered (except to add additional copyright information), AND provides a link or other credit back to my FurAffinity gallery or other appropriate social media account.
-Commissioned art may be cropped or resized by the commissioner for use as a personal icon, avatar, forum signature, or similar reasonable use. This is the only circumstance under which it is acceptable to remove my signature from a commissioned work.
-Commissioned art may NOT be used for any commercial (money-making) purpose, or included in any publication, folio, or anthology without my prior express written permission.
-High-resolution copies of most artwork is made available to the buyer upon request. The buyer may use this copy to make prints for personal use or viewing. Commissioners may also opt to repost these copies (rather than the web-sized copies I post) to various websites consistent with the other rules. High-resolution copies or prints may not be resold without my prior express written permission, consistent with the other rules.
*Commissioners wishing to use their purchases for commercial purposes, including prints, clothing, logos, or other products must inform me in advance of doing so, obtain my express written permission, and be prepared to pay a much higher price in order to buy the rights to the image. Royalties may also be negotiated depending upon the intended use.
*I will never use commissioned artwork for any commercial purpose, including prints, folios, anthologies, or other products, without the express written permission of the owner(s) of the characters involved. I may run advertisements containing images of your characters to promote my own work, but no direct sale of your character's likeness will happen without your consent.
** Canceling Commissions
*I reserve the right to cancel or refuse commissions from any person at any time for any reason. Common possible reasons for cancellation:
-Commissioner violates these terms of service in an unresolvable manner
-Commissioner is harrassing or otherwise being abusive towards me (my discretion)
-Extenuating circumstances have caused me to be unable to complete the artwork, or complete in a timely fashion
-Commissioner is unable to pay or complete payment in a timely manner
*Refunding of cancelled commissions depends on the reason for cancelation and the amount of work completed:
-If no work has been completed by me, a full refund will be issued at the earliest possible time
-If partial work has been completed, then a partial refund relative to the amount of work done will be issued at the earliest possible time
-No refunds will be issued if the time spent on the work is equal to or greater than the amount paid, regardless of the reason for cancelation
*The following are unacceptable reasons for cancelation:
-You no longer like the person/fursona you paid me to draw (I might be able to offer a different image depending on how far along the drawing is, but generally speaking, no)
-You are unhappy with this TOS (you should have read it in advance)
-You have some issue with me that is already addressed above, such as reasonable response times (for example, if it takes me more than 24 hours to respond to an email)
And finally,
I reserve the right to refuse service to any one, for any reason, at any time.
To re-iterate, it is the buyer's responsibility to be familiar with these terms. By purchasing a commission from me, you are implicitly agreeing to these terms, and to be bound and/or subject to them.
