Libra-11 Commission Terms Of Service

BY COMMISSIONING ME FOR A PROJECT OF ANY KIND, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND CONSENT TO THE PROVISIONS HEREIN. THIS IS LEGALLY BINDING.
FOR ALL INTENTS AND PURPOSES, “I” AND OTHER FIRST PERSON PRONOUNS REFER TO LIBRA-11 / HERBERT COLUNGA, “THE MANAGER” OR “AGENT” REFERS TO LURDANJO / WAYNE CHARRON, “YOU” AND SECOND PERSON PRONOUNS REFER TO THE COMMISSIONER / BUYER.
Thank you for choosing me for your artistic needs! I greatly appreciate your patronage and support. Please take the time to familiarize yourself with the following terms and conditions to ensure the smoothest transaction period and mutual satisfaction.
—HOW TO COMMISSION ME—
I will usually announce openings for commissions in public posts on FurAffinity, and my status will reflect whether I am currently open at that moment or not. If I am open, please send me or my manager, Lurdanjo, a private note describing what you would like drawn, with character references (if available) and what you would like them doing as far as poses and subject matter is concerned. You may be specific, or you may grant me artistic freedom for my interpretation of the characters and scenario, which usually allows for higher quality final product.
Even when I am closed for main commissions, I am almost always open for Picarto stream commissions, which are typically held three Saturdays per month. These are usually done faster and come with discounts based on themes, but as such might not be as high quality as the regular commissions. Please understand this before ordering Picarto commissions! Finally, I am almost always open for “slavestream” commissions. With these you pay for my time rather than the final product. For many sketches or extra characters, this may save you money. You also receive an unlimited number of revisions with me, and you get to watch the art drawn live in a private Skype chat where you may talk to me about anything you’d like while I draw. These start at $30 per hour and must be scheduled in advance.
I reserve the right to refuse, cancel, or drop any commission for any reason at my own discretion! Please see the below for the appropriate information regarding refunds.
—My Will and Will Not Draw List—
I am a very openminded artist who loves to draw many strange and exotic adult fantasies. This being said, I enjoy drawing some subject matters more than others, and personally dislike drawing some subject matters altogether. The following is a quick list of things I enjoy drawing the most, and will likely get done faster, more efficiently, and at best quality:
- Costumes, suits, and disguises
- Androids and other lifelike synthetic creatures
- Robotics, including android anatomy
- Detailed backgrounds
- Cute submissive guys (twinks or lithely muscular)
- Herms/intersexed characters
- Transformation
- Rubber, latex, and other unnatural materials
- Bondage
- Rough stuff (some restrictions might apply)
I am open to many other fantasies, but there are certain things I would like to not draw under any circumstances. These include but are not limited to the following:
- Scat and vomit (but I will do watersports/pee)
- Realistic vore
- Death and realistic gore
- Fat furs (300+ lbs, no disrespect to actual obesity, just something I personally don't enjoy drawing)
- Excessive bodily fluids
- Excessively anime-inspired characters (determined on a case-by-case basis)
- "Realistic" character proportions in general. Please look at my gallery to see the types of body builds I draw to see if I'll draw that sort of character.
- Anything related to Steven Universe or Adventure Time (those shows actually trigger PTSD in me, please do not ask why)
I reserve the right to change either list at any time without prior notice, which may take effect immediately! I don’t want to have to do that, but sometimes a fetish I once enjoyed can be completely ruined for me and then I’d rather never see it or draw it again.
Some details will take me more time to get right, and thus incur a premium charge on top of the regular commission price. They include, but are not limited to:
- Extra characters (roughly one third base price each)
- Complex character details, such as wings, large amounts of markings or accessories, merging/transformation detail, etc.
- Suit details (half an extra character cost)
- Mechanical details ($10-$30 depending on complexity)
- Exact reproductions of a specific pose or scene ($10-$30)
- Backgrounds (included in Complex Shaded pictures, others start at $15)
- Anything not on my “will not draw” list but that still somewhat annoys me or seems like not a fun project (up to 50% more full price), DECIDED AT MY DISCRETION
—Payment—
All payment must be received before I begin, or in halves for larger projects under special circumstances. Please be ready to pay at the time that you submit a commission request or your slot may be forfeit, unless you put down a $5 nonrefundable slot reservation fee in advance.
Payments are made to my manager's PayPal Business account. He will send invoices via PayPal once a price has been agreed upon to the email address that you specify. You may also pay using a credit or debit card via our Square transaction system, where you will need to fill out a different form. Finally, we also accept Steam gift card transactions, but they will only count as 75% of their value as the usages for Wallet funds are obviously more restrictive than cash! (for example, a $20 steam card will count as $15 toward a commission, a $50 card counts as $37.50, and so on)
My manager and I reserve the right to quote higher prices than what is listed on our price guide depending on various situations, although this is very rare. Also, Picarto commissions that are not adequately elaborated on will be assumed to desire the highest end possible and will be priced accordingly (for example, Doodle Page without specifying the number of doodles will assume the highest number and price).
—Discounts And Deals—
Discounts are given to Patreon supporters who contribute at least $15 a month. They receive 10% off Picarto commissions, which stacks with existing discounts up to 50% off. Higher Patreon tiers offer higher discounts, so if you’re looking to get very large projects from me or commission me often, this may be a smart option! I may also offer discounts at my discretion to good customers who offer me repeat business and are great to work with. One example might be to offer a substantial discount to the fourth project after three others of equal or greater value have been completed with everything running smoothly and topics I enjoy.
—Revision System—
For regular commissions, you get one major revision session for the linework and one major revision session for the coloring phase, if applicable. This is your chance to tell me anything that I made wrong in the sketch for changes. Once the revisions have been made, further revisions of the same kind will be pro-rated at 83 cents per minute spent making the changes, unless said changes were based on mistakes from the description you gave me. This also applies if you ask for line art changes during the color phase, to give an example, which creates even more extra work as I have to dismantle all the way down to the original sketch and then change the coloring that I've already started.
For Picarto commissions, revisions are extremely limited. You may alert me live in chat if I have made clear mistakes and ask for small changes as they happen, but I will not make any large changes after the fact. Again, Picarto commissions are meant to be quick and less expensive, and to be fair to everyone we can’t spend too much time making every tiny detail perfect. My regular commissions are better for that. :)
Redoing an entire sketch for trivial reasons (such as it not facing the exact way you had pictured in your head when it was not listed in the description) will incur a charge of 83 cents per minute pro-rated ($50 per hour), rounded up to the nearest dollar.
If you have very exact colors that you want me to use, please give me the number of the color in RGB value.
—Things To Consider—
- I am not a native English speaker, so I apologize in advance if there are misunderstandings due to the language barrier. I can also sometimes be unorganized and easily forget details, or make dyslexic errors. This is why I recommend you go through my manager for communication and details as he is able to make sure I create the best and most accurate work for you.
- I am a very busy individual and cannot possibly add everyone who wants to converse with me onto Skype. The exception is of course for slavestreams, though customers will usually be removed once the slavestream is finished. Nothing personal!
- If you feel I am taking too long with your commission, you reserve the right to request a full or partial refund depending on my progress. This doesn't mean I will necessarily give it out, however, but I am certainly willing to work with you to come to an acceptable compromise. More details below.
- You reserve the right to give me constructive criticism on any of my work at any time, including (and especially!) the work I provide for you. However, direct insults aimed toward me or my manager will NOT be tolerated, and will be grounds for immediate termination of your commission and a blacklisting from future commissions. Extreme cases will also forfeit any right to a refund, such as threats and clear abuse. On very rare occasions we might look into a prospective commissioner's past behavior and decide whether or not to do business with that person, or to charge higher prices if we suspect that they will be difficult to work with.
- I can sometimes mimic different styles to better match a character's reference or a Rule 34 request, but I will not go out of my way to make sure I perfectly mimic a different style. I will also not mimic the styles of specific other artists in the furry fandom, as that is unfair both to me if I charge lower prices and to the original artist that should be receiving the commission in that case.
- I do not wish to have to spend a long amount of time researching a character's appearance or back story to complete a commission. Reference pictures should be good enough, but if I need to read a large portion of writing or watch a lot of video to get a commission down right, I reserve the right to charge for that extra amount of time spent doing research, up to $50 per hour.
- I am not responsible if a commission has been paid for but the buyer turns out to not have been able to afford it. Please do not commission me unless you know for absolute certainty that you can afford me as I do not offer refunds on the grounds of a buyer having spent all of their money on me instead of more important things like food or rent. I reserve the right to refuse a refund for any reason other than an emergency on the buyer’s part.
- In case I cannot complete the art you have commissioned from me, I may offer partial refunds at my discretion. This list of refund percentages are as follows, giving the example of a full color piece:
* 80% if the item not started (this is due to the work involved in bookkeeping and maintaining invoices as well as holding slots, this can be waived if I refund your money due to not being able to start your commission for unforeseen circumstances, not for refund requests)
* 70% if the sketch was finished
* 60% if the sketch was edited for inking
* 45% if the inking was completed
* 35% if the inking was edited for coloring
* 25% if basic coloring was applied
* 10% if coloring was finished but not fully revised/approved
* 0% if coloring was approved and completed. This is considered a finished product, and once a product is finished, there are no refunds, no exceptions.
- Once the art has been finished, you may post it to any online galleries that you wish, use it for a reference for any reason, print it out for yourself for any reason, and share it with any friends you desire for any reason. However, you may NOT do any of the following:
* Sell or post the work/character created for a profit or to a pay site
* Distribute without a credit to myself, Libra-11, and my manager, Lurdanjo, when applicable
* Edit the work without permission and then post it. Please note that you may ink and color my work as the exception, and that sometimes I will grant permission for you to edit my work at my discretion.
* Post anything that was not specifically commissioned for you, such as image portfolios, comics, or Patreon exclusives. This especially will be grounds for blacklisting of all future commissions and contacts as well as a post to the Artists Beware community.
- I reserve the right to do anything I want with art I create for you, with the sole exception being if you have bought the full rights from me. This includes altering your commission for various purposes such as to make YCHs, posting your commission on art CDs or Patreon, and whether or not I post it to my own gallery at all.
- If you wish to buy the full rights to an image, we can negotiate that price but expect it to cost at least twice the price of the original piece or more. I will not sell the rights to images involving other people's intellectual property for legal reasons.
- InFiniTos Studios has the right to alter the contents of this documentation for any reason without advance notice, which will take effect proactively. Any commissions taken before or while the document was changed will be exempt from the new rules or restrictions at my discretion only.
