When the word commission is being used in this tos I refer to: all commissions, all your character here’s (YCH’s), all adoptable’s, all raffle art and all gift art made by me or in collaboration with my partner Silkyfangs.
COMMUNICATION AND PAYMENT
- All payment is via Paypal (invoiced by the artist)
- Payment is required before ANY work begins. All payment under $150 or under requires full payment before starting, any quote for work $150 and over requires 50% deposit (not including shipping) before artist starts working on the sketch.
- Corrections can be made during the sketch phase. Small changes are free, the first large edit is free. After the first, editing fees will be applied. Small changes to the completed stage are also free, partial or entire edits to the completed stage will result in large additional fees.
- Once the piece is finished, the artist will send the final artwork. If the client has paid 50% of the full rate or less, the client will receive a watermarked version and be requested to send the rest of payment before a clean file is sent. If client has already paid in full, the full-size version will be sent when the work is completed.
- Errors that are the artist's mistake can be fixed free of charge, even after the commission has been completed. For example: wrong eye color
- Artist may need time to finish the commission.
- Artist may use a raffle reward painting as a reward for patreon(s) by making the highres file available to them
- For commissioned art the highres file is only shared between commissioner and artist, unless both agree otherwise
- If commissioner wishes the artist to add the info in the FA upload menu’s, they will ask for this and give the info during the commission proces.
REFUNDS & CANCELLATION RULES
- Refunds are not available for premade merchandise (adoptable’s, downloadable content)
- When cancelled at the beginning, the kill fee will be 20% of the full cost of the commission. If full or partial payment has been received, this fee will be deducted and the remainder will be refunded to the commissioner.
- If only the sketch has been completed, the kill fee will be 30% of the full cost of the commission. If full or partial payment has been received, this fee will be deducted and the remainder will be refunded to the commissioner.
- If coloring has started on the commission, no refund will be available.
RIGHTS AND PERMISSIONS
- All commissioned work may be used by the artist for commercial purposes (prints, merchandise, advertising.) If a client specifies that they do not give their permission for commercial uses, they may be subject to a fee to purchase the rights themselves. This is on a case-by-case basis, and will be discussed between the artist and client.
- The artist does not claim ownership of any intellectual property (characters, etc) depicted in work done unless otherwise stated (for example: Intellectual property created by the artist and requested by the client). The artist does retain full rights to all images produced and may showcase art produced online and elsewhere. The artist may use images in portfolios, sketchbook collections, as commission examples, and all other forms of self-promotion. However, the artist will not sell prints or any other merchandise of individual pieces containing or depicting original characters without client’s permission.
- If a client wishes to remain anonymous, their name can be omitted from postings online. If a client wishes their art not to be posted online or otherwise shown, this can be arranged (for example: gifts, etc). Please note that clients wishing their works not be posted must understand that they are also expressly forbidden to post or share the artwork they receive anywhere online. By doing so, they are clearly allowing the artist to post it themselves.
If you want the artwork kept private indefinitely, The artist will do that for an additional charge 50% of the commission price. This fee does not apply to commissions kept private only for a set amount of time, such as holiday or birthday gifts.
- Client may never claim work done under this contract as their own, redistribute it, sell for profit or use it for any external commercial project. Non-commercial projects (for example, making prints of commissioned art but not-for-profit) must be discussed with artist beforehand to confirm no profit will come from the artist's work to the client.
If you decide to give away for example a adoptable or commission please let me know. Also let the person receiving the commission/adoptable know this tos applies.
- Watermarks or signatures, when present, are not to be removed, erased, cropped out, or shrunk too small to be easily readable. If an image must be cropped or shrunk (for use in a profile, avatar, background, etc) credit must be listed in a visible area in a readable font with appropriate link(s) included (i.e. on twitter credit may be given in the user's bio).
- Never any underage, shota/loli or cub in a nsfw context for any of the adopts I created/designed
- If you wish to turn an adopted design from feral to anthro or visa versa or make any other significant changes to the design please contact me first.
DO’S AND DONT’S
- I reserve the right to decline any commission at any time if it upsets my sensitivity or lies outside of my comfort zone.

License/tos agreement for downloadable products/resources
Downloadable products/resources are for example brushes, patterns or textures created by the artist. When downloading and or using the products you agree to the following:
You will have a license for personal use on an unlimited number of personal projects that are not used or distributed in any commercial manner; and respect to one commercial Work, with up to a maximum of, as applicable, 2,000 sales of the Work or 20,000 monthly views of the Work.
If you wish to extend this license, contact the artist.
Unless you made a different agreement with the artist you will not:
- publish, sell, license, offer or make available for sale or licensing, or otherwise distribute the Product except as part of a Work or through a form of sharing that is authorized in this Agreement; or publish, distribute or make available the Product through any online clearinghouse platform.
- make any copy of the Product except for archival or backup purposes;
- circumvent or disable any access control technology, security device, procedure, protocol, or technological protection mechanism that may be included or established in or as part of the Product;
- hack, reverse engineer, decompile, disassemble, modify or create derivative works of the Product or any part of the Product;
- publish, sell distribute or otherwise make the Product available to others to use, download or copy;
- transfer or sub-license the Product or any rights under this Agreement to any third party, whether voluntarily or by operation of law;
- use the Product for any purpose that may be defamatory, threatening, abusive, harmful or invasive of anyone’s privacy, or that may otherwise violate any law or give rise to civil or other liability;
- misrepresent yourself as the creator or owner of the Property;
- remove or modify any proprietary notice, symbol or label in or on the Product;
- directly or indirectly assist, facilitate or encourage any third party to carry on any activity prohibited by this Agreement.
